End User License Agreement (EULA)

1. License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User," "End User," or "you") and Game Launcher Cloud ("Company," "we," "us," or "our") for the use of the Game Launcher Cloud software, platform, and any related services or content (collectively, the "Software").

BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. If you do not agree to the terms of this EULA, do not install, access, or use the Software.

This EULA supplements and works in conjunction with our Terms of Service and Privacy Policy. In case of conflicts, this EULA takes precedence for software-specific matters.

3.1 Limited License

Subject to your compliance with this EULA, Game Launcher Cloud grants you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Software on your devices for personal or business use
• Access and download Third-Party Games through the Software
• Use the platform's features and services as intended
• Receive automatic updates and patches

3.2 License Scope

This license applies only to the Game Launcher Cloud software and platform. Each Third-Party Game may have its own separate license agreement that you must accept before use.

3.3 Subscription-Based Access

Some features of the Software may require a valid subscription. Your access to subscription-based features is contingent upon maintaining an active, paid subscription account.

4. License Restrictions

You may NOT:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
• Modify, adapt, alter, translate, or create derivative works of the Software
• Remove, alter, or obscure any proprietary notices or labels on the Software
• Rent, lease, lend, sell, redistribute, or sublicense the Software
• Use the Software for any illegal or unauthorized purpose

4.2 Platform Restrictions

• Attempt to gain unauthorized access to our servers or networks
• Interfere with or disrupt the Software or servers
• Use automated scripts, bots, or tools to access the Software
• Circumvent any security measures or access controls
• Upload malicious code, viruses, or harmful content

4.3 Content Restrictions

• Distribute copyrighted material without proper authorization
• Share account credentials with others
• Use the platform to distribute illegal or harmful content
• Violate any applicable laws or regulations

5. Third-Party Content and Games

5.1 Third-Party Licenses

Each Third-Party Game may have its own End User License Agreement, terms of use, or other legal agreements. You are responsible for reading and complying with all such agreements.

5.2 Content Liability

• We do not review, approve, or guarantee Third-Party Content
• Third-party developers are solely responsible for their content
• Users download and use Third-Party Games at their own risk
• We are not liable for any damages caused by Third-Party Content

5.3 Content Removal

We reserve the right to remove any Third-Party Content from our platform for any reason, including but not limited to legal violations, user complaints, or platform policy violations.

6. User Responsibilities

6.1 Account Security

• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized access
• Use strong passwords and enable two-factor authentication when available
• Accept responsibility for all activities under your account

6.2 System Requirements

• Ensure your system meets minimum requirements for the Software
• Maintain a stable internet connection for online features
• Keep your operating system and security software updated
• Provide adequate storage space for downloaded content

6.3 Legal Compliance

• Comply with all applicable local, national, and international laws
• Respect intellectual property rights of all content creators
• Follow age restrictions and content ratings for games
• Report any illegal or inappropriate content to us

• We do not guarantee uninterrupted or error-free operation
• The Software may be unavailable during maintenance periods
• Third-party services may affect Software functionality
• Network connectivity issues may impact performance

• We do not guarantee the accuracy, quality, or appropriateness of Third-Party Content
• Content ratings and descriptions are provided by third parties
• Game functionality and features may vary or change over time
• We are not responsible for user-generated content within games

8. Limitation of Liability

8.1 Maximum Liability

In any event, our total liability to you for all damages shall not exceed the amount you paid for the Software or subscription services in the twelve (12) months preceding the event giving rise to the claim.

8.2 User Responsibility

You acknowledge that you use the Software and download Third-Party Content at your own risk. You are responsible for any consequences of your use of the Software.

9. Updates and Modifications

9.1 Software Updates

• We may provide updates, patches, and new versions of the Software
• Some updates may be automatic and mandatory for security or functionality
• You consent to automatic downloads and installations of critical updates
• Updates may modify features, remove functionality, or add new requirements

9.2 EULA Modifications

We reserve the right to modify this EULA at any time. Material changes will be communicated through the Software, email, or our website. Continued use of the Software after changes constitutes acceptance of the modified EULA.

9.3 Feature Changes

We may add, modify, or discontinue features of the Software at any time without prior notice. We are not obligated to provide specific features or maintain backward compatibility.

10. Termination

10.1 Termination by User

You may terminate this EULA at any time by uninstalling the Software and ceasing all use. Termination does not entitle you to refunds for subscription fees already paid.

10.2 Termination by Company

We may terminate this EULA and your access to the Software immediately if you violate any terms of this agreement or engage in prohibited activities.

10.3 Effect of Termination

• Your license to use the Software immediately ceases
• You must uninstall the Software from all devices
• Access to your account and downloaded content may be revoked
• Provisions regarding liability and disclaimers survive termination

11. Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico), without regard to its conflict of law principles.

Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the competent courts in Mexico.
